The eviction of two of the four squatted roadside properties owned by the Consell de Ibiza has commenced. They are the road workers house located in ses Salines and a house next to the crossroads of Jesus, that both the City Council of Sant Josep and Santa Eulร ria requested the evictions to be carried from the insular institution. The other two are in Sant Jordi and Sant Rafel.
This was the reason that led the Consell to issue an order to conduct an inspection to find out how many road properties are under its jurisdiction. “There we realized that we had four, maybe there is a fifth in Sant Joan, and that they were all squatted. No government had done anything about it until now,” justifies the conseller of Territory and Road Infrastructure, Mariano Juan.
The legal status of each property is different. Some of these properties are public domains, which means that they cannot be occupied, that is to say, they carry an extra protection that does not allow them to belong to the squatter.
However, some of these buildings are heritage properties, so they can be occupied if the people who live there can prove that they have been in that property for a certain number of years. “When the legal report is drawn up on the situation we have, we send notifications to each of the squatters to interrupt the sqatting process (in two of the dwellings). If the Consell notifies the squatter that it is theirs, the process is interrupted and this is the way to protect the property”, explains Juan.
Eviction of squatted properties in action
In this sense, the Consell interrupted the possibility of the squatters claiming the properties before summer and the Policรญa Local officers were in charge of notifying the people who inhabit the four squatted properties of the eviction. But in the case of those in Jesus and ses Salines, a further step was taken. “We have initiated the process of official recovery and they have been notified of a resolution, signed by the president of the Consell, which says that these infrastructures are the property of the institution and they are urged to justify why they are there. This has been done during summer and the squatters have a deadline to submit their case,” says Juan.
In the case of the workers house of ses Salines, they have not made a claime. “The president has already resolved the procedure and, in the next few days they must abandon it. If they don’t, which is what happens in most cases, it is a case of going to court to ask for authorization (as happened in May in the squatted house in Sant Mateu)”, he says.
