The Consell de Ibiza has assured in a press release that the modification number 2 of the Insular Territorial Plan (ITP) does not allow the legalization of Cathy Guetta’s basement, as stated by the mayor of Sant Josep, Angel Luis Guerrero. In the communiqué, the Consell de Ibiza explain that, the Department of Land Management, upon learning of Guerrero’s statements published by Diario de Ibiza in which he assured that “it is outrageous that this modification is approved for things like legalizing the basement of Cathy Guetta’s villa” wanted to clarify that with the modified norm, which has the wide support of official bodies, associations and groups involved, in no case legalizes a work like the one described by Guerrero.
With respect to basements, the note highlights that the new wording of the PTI states that certain uses in basements will not be counted within the maximum 900m3 for dwellings, and these uses are specified: vehicle parking, building infrastructure services, distributor, storage room, dressing room, wine cellar, gym, laundry, pantry, games room and cinema room, limiting the maximum area of the basement which, as a whole, may never be greater than the floor of the new house.

“Specifically, the new rule states that, in any case, none of the 800 m2 of basements made outside the floor of Cathy Guetta’s home could be legalized and only half of the basement that exists under the footprint of the house could be legalized (that is, it can not exceed the limits of the walls of the house),” indicates the Consell de Ibiza. As the note explains, it would not be possible to legalize any basement used as a nightclub like the one referred to by the City Council. In addition, the Consell de Ibiza recalls that the license given by the City Council for the mentioned basement (400m2) authorized more meters than the new regulation allows. The Consell explains that the illegal works of the mentioned villa already have a file for urban infraction and demolition order “that the City Council of Sant Josep should be concerned in carrying through”, points out the note. The Consell de Ibiza invites the mayor of Sant Josep to read the new wording of the PTI and evaluate it “when he understands it in detail”. “Making statements without, as he himself admits, not having read the text despite having it since last November, shows propagandistic intent, in search of a headline with the sole purpose of defaming without knowing what he is talking about,” concludes the statement.
