Illegal rental house in Ibiza Natural Park with pending sanction file open

The Consell is studying the allegations presented on the rental property, but "the intention is to restore legality on rural land".

Idealista, Fotocasa and other online real estate portals continue to fill up, every day, with exploitative rental offers in Ibiza. It’s the same case as a wooden house “for renovation” in ses Salines. It features 30 m2 of useful floorspace, but it is unfurnished and the kitchen is not equipped. The owner asks for a minimum rent of six months (1,200 euros per month) plus three months deposit.

In exchange, according to the rental ad, the tenant will enjoy “a private entrance and garden and a terrace overlooking the sea”. As reported by this newspaper in November 2021, the person responsible for the construction of this illegal house in the Natural Park of ses Salines on Ibiza had another built and had began work on a third house, also in a protected area, for which the Consell opened a sanction file for 135,834 euros (275% of the estimated value of the work) and another for re-establishing urban discipline for the wooden house.

The alleged offender requested access to all documentation and a time extension to present arguments and have finally presented them, as confirmed yesterday by the Consell. “Work is currently underway to verify the evidence, which is supposedly absolving, provided by the alleged offender and that, in some cases, implies having had to consult other administrations, which delays the process,” they added. It must be taken into account, they specified, that the system is very protective and each piece of evidence must be studied, but “the intention is to restore legality on protected rural land”.

In addition, on the same property as the wooden construction there is a main house, which is on urban land (the same property shares the two uses), so the Consell transferred the record to the City Council of Sant Josep to find that it was rented without authorization for tourist activity.

At the same time, inspectors of the island’s highest institution carried out an inspection a few weeks ago and “all the ads they found were seasonal, not tourist stays, so they could not open a file,” stressed sources from the Consell.

But this is not the only ad that attracts attention. In the zone of the port of Ibiza there is a 50 m2 rental apartment for during the summer season which the entry cost  7.500 euros (deposit, agency and the first month). It has only one room, where the bathtub is located, since the “bathroom” has only a toilet and sink.

In Portinatx there is a penthouse for rent, for a minimum of two months, “exclusively for non-residents who need seasonal housing”. They ask 7.000 euros per month for two rooms, but they assure that “it is a work of art”. “The property is located on the second floor of the building without an elevator, you can walk to the beach which is a few meters away and also take a dip in the communal pool. It is ideal for a couple, but it is not suitable for small children”, reads the ad.
