The TSJB ratifies 50,000€ fine for illegal party at the Polvorín on Ibiza

It considers the fine for the illegal party, which Santa Eulària reduced by 25,000 euros, to be proportionate, due to "the undeniable risk of fire".

The High Court of Justice of the Balearic Islands (TSJB) has confirmed the penalty of 50,000 euros that the Santa Eulària City Council imposed on the company Ideas de Ibiza, owner of the former Santa Gertrudis military warehouse, for organizing a massive illegal party without permission from the evening of July 13th, 2014 until noon the following day.

This illegal party, whose theme revolved around Stanley Kubrick’s highly sexual film ‘Eyes Wide Shut’, provoked many complaints from neighbors. Initially, the City Council reported that a fine of 75,000 euros had been imposed on the promoters of the illegal party, but in the end part of an appeal for reconsideration by the property was accepted and reduced to 50,000 euros.

Not content with the reduction of the fine, the property appealed to the courts. In the first instance, the claims were dismissed and now also by the High Court of Justice of the Balearic Islands. The property wanted to show at all times that it was a private party, specifically the birthday of a friend, and that the fine was disproportionate. As an alternative, it proposed the reduction to 10,000 euros. Days later, the promoters apologized to the neighbors for the inconvenience caused, assured that there would be no more parties in this space and that their project is cultural.

The sentence considers it proven that, regardless of whether or not it was a birthday celebration (one of the owners, Alejandro Lozano, declared to this newspaper that it was a party to celebrate the 50th birthday of the other owner, Lio Malca, with a long career in the art world), “a massive party” was organized without the corresponding permit. More than 500 people attended, perhaps more than 1000, according to the ruling.

300 parked vehicles during illegal party

There were more than 300 parked cars in the two parking lots, in addition to remarkable organization that included people controlling the access to the venue, security companies and rental vans with drivers and shuttle buses.

The TSJB highlights that the illegal party had extensive organization, access controls, decoration, lighting and music and projection equipment, as well as discretional transport service from a parking area located in the vicinity of the Sant Rafel racecourse. It also points out that the plot is located on rural land and that the celebration of parties is not allowed in the matrix of uses.

The facts are considered proven from the Policía Local’s report, the documentation collected, such as photographs of the party, the flyer type advertising and the witnesses’ own statements.
