Partying illegally in a house on Ibiza will have consequences not only for the organizers, but also for the owner of the property where it takes place and for those who attend. This was announced yesterday at a press conference by the Minister of the Presidency for the Balearic Executive, Mercedes Garrido, who explained that at the next Consell de Govern the amendment of the Regulation of Activities will be approved by decree law in order to act “forcefully” against this problem.
“It is a change adapted to the Constitution and to the basic rights that we as citizens have. It is a proposal that all the administrations (Govern, Consell and city councils) share. It is intended to be a deterrent measure and that people are aware that engaging in an illegal activity, which is for profit, will have consequences,” stressed Garrido.
In this sense, the institutions are “inflexible”, so the new regulation will define exactly what an illegal party is, which will allow the identification of those who are responsible for it. But the penalties will reach everyone who is partying illegally: organizers, the property owner, collaborators (those who sell tickets, advertise, provide material means such as sound equipment, DJ’s, catering, transport…) and all participants.
Costly fines for partying illegally
Fines will range between 100,000 and 300,000 euros for organizers, marketers and collaborators, with the additional factor that if there are complaints from neighbors, they will not go below 150,000. It will also depend on whether the property is on protected land or not, the amount being higher in the first case.
The owner of the house also faces a fine of at least 100,000 euros. And what happens if they did not know that an illegal party was going to be held on their property? They will be required to prove it. “It is understood that the owner is responsible for their property. Justice interprets that you have control over what is done with it”, Garrido specified. For his part, the president of the Consell, Vicent Marí, added one more development: “If the party is in a holiday home, the owner will lose the authorization that allows them to rent the house for tourism”.
As for those attending the event, they will be hit with an automatic fine of 300 euros. Then it will depend if they have also collaborated with the party which, if so, the fine will reach up to 30,000 euros. As a final detail, it has been proposed that it will not be necessary to wait for the initiation of a sanctioning file for the competent bodies to be able to apply precautionary measures.
Deterrent effect for partying illegally
The president of the Consell acknowledged that the idea that the institution proposed to the Govern was “more ambitious”, with “more forceful” measures. “We wanted to be allowed to act at the time of the party, but there are legal issues that have not been included in the decree that has been drafted,” said Marí. In this line, he recalled that the agents cannot gain access the interior of the houses without a court order, which makes it difficult to identify the people who are at the party, although Garrido added that “at some point they have to leave”.
