In ibiza two teenagers guilty of stabbing a Guardia Civil

The Provincial Court rejects the appeal of the aggressors, who are serving two years in a closed regime and another two on probation

The Second Section of the Provincial Court has decided to dismiss the appeals filed by the defences of the two convicted for the assault on two Guardia Civil agents on New Year’s Eve 2020 at the exit of a bar in Ibiza municipality of Santa Eulària, resulting in one of them suffering serious injuries, several of which were caused by a knife.

At the time of the facts, the two convicts were minors. On August 30, 2021, the Juvenile Court number two of Palma issued a sentence condemning these two teenagers to two years of internment in a closed regime and another two years of probation for a crime of injury with the use of a knife.

Furthermore, it agreed to prohibit approaching the two victims from a distance of not less than 500 metres, as well as communication “by any means for a period of two years for each juvenile,” who were also ordered to pay compensation in varying amounts. The Court has now approved all of these measures.

The events already judged occurred approximately 6.30 a.m. on January 1, 2021, according to the statement of the facts contained in the high court’s verdict, for which Juan de Dios Jiménez Vidal was the prosecutor.

The facts are recounted

“On the local’s exit steps, an altercation erupted between Tomás [fictitious agent’s name] and a young woman (…) because Tomás mistakenly spilt a glass of drink, splashing the young woman, who was accompanied by another young man of Moroccan origin.”

The sentence continues, “when his companion José Manuel [fictitious second agent’s name] ] tried to mediate in the discussion to put an end to it, the young man of Moroccan origin attacked him with a punch and started shouting ‘they have hit a woman,’ and then shouting ‘let’s go get the guards,’ and guided with the intention of undermining the integrity of José Manuel and Tomás, the two minors, along with two other adults of Latin origin, rushed at the two complainants and began to kick and punch them”.

Tomás “was thrown to the ground and assaulted until, at a certain point, one of the four aggressors took a sharp object and stabbed him three times in the buttocks region, taking advantage of his defenceless situation and the vulnerable position in which he was without the ability to defend himself, stab wounds that did not affect any vital organ.” “He was swiftly taken to the health centre by a Guardia Civil patrol, and from there to the hospital in an ambulance because he was losing a lot of blood as a result of the wounds sustained,” according to the report.
