A 78-year-old man, resident in Ibiza, who sexually abused his grandniece on two occasions in Cáceres, when the girl was only 10 and 13 years old, will avoid the two years in prison to which he was sentenced by the courts for two separate offences of sexual aggression (for each one he is asked for one year).
The Provincial Court of Cáceres has sentenced the accused, who will not be sentenced to prison if during the five-year probation period imposed by the judge he complies with the prohibition not to communicate with the victim and not to approach her home or any other place frequented by her within a distance of 200 meters away and with the obligation to participate in a sex education program.
The abuses were committed during the family member’s visits from Ibiza to the town in Extremadura where part of the family lives and while the child was living with her maternal grandparents, where the mother had decided that it was necessary for her to move from the island (where they also live) after the death of the father and because her work schedule prevented her from taking care of the child, especially in summer.
“I thought it was best to have her cared for by my parents.”the victim’s mother told this newspaper. Then, in winter, she would go to Cáceres for several months.
Abuse in a family home
The first abuses by the convicted man took place in 2019, when the brother of the minor’s maternal grandmother was with the girl, then ten years old, in the living room of the home of an aunt of his and began hugging and touching her over her clothes in the pubic areaand also on her breasts and ass, in order to satisfy her sexual desire, according to the indictment of the Provincial Prosecutor’s Office of Cáceres.

“I noticed that something strange was happening to my daughter, but no one warned me of the complaint.”the mother told Diario de Ibiza. “Whoever you least expect it looks at the things he does to you, all this is overcoming me,” she said with pain.
During the trial, held last November 28 at the Provincial Court of Cáceres, the prosecutor, on behalf of the victim, reached an agreement with the defendant’s lawyer, who admitted the charges and, therefore, benefited from a reduced sentence, which remained at two years in prison as the author of two crimes of sexual assault on a 16-year-old minorwith the concurrence of the mitigating circumstance of reparation of the damage, and the accessory penalty of special disqualification for the right to passive suffrage during the time of the sentence.
The mother, who did not file a private accusation given that the school had already acted ex officio, regretted before the trial that the accused “would not go to prison”this is something that the man can avoid if during probation he does not reoffend and complies with the judge’s prohibitions and duties.
The convicted person will also be disqualified for seven years from any profession that requires contact with minors and will have to pay a immediate” compensation of 3,000 euros 3,000 in civil liability and costs. The sentence also includes a ban on communicating with the girl for six years and a 200-meter restraining order, which is difficult to comply with, since they both live in the same neighborhood in a municipality on the island of Ibiza and there is barely “one hundred meters away” between the houses.
“Every day we coincide because he lives right next door. The other day my daughter met him full-on twice on the same day,” the mother lamented. “She had an anxiety attack and needs psychiatric care because she doesn’t even want to leave the house anymore, she doesn’t want to go to school either,” added the woman, who also lives a “hell.” since the abuses occurred.
