Perpetrators of the fire that destroyed judicial archives on Ibiza sentenced to 4 years in prison

The judge declares Francisco Fonseca the perpetrator and Jonathan Cazorla the inducer of the fire, but exempts him from co-perpetration.

Ibiza’s first level criminal court has sentenced Francisco Fonseca and Jonathan Cazorla as the perpetrators of a crime of damage for their involvement in the fire at the old courts of Ibiza in January 2019, to four years and one day in prison – the prosecution demanded a sentence of four years and ten months in prison -, the Balearic Islands High Court of Justice reported yesterday in a note. In addition, they must pay a fine of 6 euros per day to be paid for 18 months and one day.

The magistrate, Clara Ramírez de Arellano, also ordered with joint liability for them to compensate with joint liability the Ministry of Justice with the amount of 409.555.35 euros for the damages caused, the Consell Insular de Ibiza -to which the Fire Department belongs- with 3,411.71 euros for the cost of the action, and to the other injured parties, -workers of the courts with personal belongings- with 175 euros. The resolution is not final, and an appeal can be made to the Provincial Court of the Balearic Islands.

The fire was Cazorla’s decision in order to hinder several ongoing judicial proceedings against him after he was found guilty of the fire in the squat building of es Viver, in which Rosanna Venturini, a 59-year-old woman who lived there died. The files were in the courts of Instruction 1 and 2, those affected by the fire. The fire started in the early hours of Monday, January 21st, 2019. The second and third floors of the former headquarters of the Ibiza courts caught fire, while the smoke affected the fourth and fifth floors.

In the sentence, the judge details the reasons why she has “reached the full conviction that the defendant Fonseca was the material perpetrator of the fire of the building of the judicial headquarters of the Courts of Ibiza”. The judge points out that she understands the participation in the crime of the other defendant, Jonathan Cazorla, as an inciter.
