The Ibiza Council’s Department for Combating Intrusion has decided to impose six fines of 4,000 euros, 6,000 euros, 12,000 euros, 20,000 euros, 25,000 euros and 44,000 euros – six sanctioning proceedings in total – for the commercialisation of illegal tourist accommodation in the towns of Ibiza, Sant Antoni, Sant Josep, Santa Gertrudis and Jesús.
These six sanctions, which total 111,000 eurosthe cases have been processed after the tourist inspection service of the institution reviewed these dwellings and found infractions in tourism matters for advertising, contracting and marketing without having presented the corresponding responsible declaration of initiation of tourist activity or prior communication, according to the insular institution in a note.
In two of the cases it has been sanctioned with 4,000 euros and 6,000 euros the marketing through Facebook groups and platforms such as Airbnb of renting rooms for days within homes.
The Councilor for Combating Intrusiveness, Mariano Juan, recalled that whoever advertises this type of illegal rental through Facebook groups “is exposing himself to the inspectors and the police, identifies who the offender is and allows us to move forward with the disciplinary proceedings. Renting rooms for days within a dwelling is also an illegal activity and, therefore, punishable”, remarked Juan.
Obstruction of the inspectors’ work
Juan has also explained that another of the sanctions already welcomes the minimum penalty amount of 40,000 euros that was modified by law thanks to the claims made from Ibiza in the last legislature and, in addition, the marketer faces a penalty of 4,000 euros to obstruct the task of the inspectors of the Consell de Ibiza, for which it has also been sanctioned.
All the dwellings described are not susceptible to tourist commercialization on the island of Ibiza. The advertising of all of them was carried out without having presented the Responsible Declaration of the Start of the Tourist Activity, and without being registered in the Insular Register of Companies, Activities and Tourist Establishments. The properties were advertised through platforms and social networks with availability calendar, check-in and check-out indications, reservation cancellations, and other services.
The institution has collected 1.5 million euros in sanctions for tourism management, more than 80 people have already been identified who advertise apartments on platforms such as Airbnb and between 400 and 450 ads have been removed on social networks, according to the balance made by Mariano Juan.
