Youths fined 60,001 euros for holding a botellón on a Formentera beach during covid

The Govern imposes the full weight of the law on a group of youths for holding a botellón. The parents of some of them claim that "the fine is an atrocity".

Justice is sometimes slow, but in the end it comes. One year and two months after a group of young people were identified by the Formentera Policía Local, each of them has been fined 60.001 euros for participating in a botellón on the beach in the middle of the covid pandemic, reports Diario de Sevilla.

Among those affected by the sanction are three young women from Seville and the father of one of the 27 year olds tells this newspaper that the imposed fine is “an atrocity, unfair and exorbitant”. He adds that his daughter and her companions did not participate in this botellón, but were at a famous beach bar on the beach Cavall d’en Borràs and that at about 8:30pm they approached the beach to take a picture of the sunset and when the beach bar closed, the other customers also piled onto the beach to create a botellón. The parent adds that when the girls left they found a Policía Local control in the parking lot that was identifying those leaving the beach, but says that the agents did not ask them at any time whether or not they were part of the binge drinking group.

The father tells Diario de Sevilla that there is the possibility, for prompt payment, that his daughter’s fine will be reduced by 40%, reducing it to 36,000 euros, but it is still a large sum of money. For this reason they have entrusted everything on the contentious-administrative route: “We have put everything in the hands of a prestigious law firm in the Balearic Islands”. He is also pinning his hopes on the approval of the appeal for unconstitutionality, presented by Vox, which was approved by the Constitutional Court in relation to the Decree-Law 5/2021 that modified, at that time, the Public Health Law of the Balearic Islands, will be admitted for processing.

On the other hand, the newspaper El Liberal, which has also spoken to the father of one of those affected, says that among those who have received this notification from the Balearic Government there are many young people who have suffered anxiety and who have already spent almost 1,500 euros in lawyers.

As can be read in the sanction that has reached these young people and published by the Sevillian newspaper, the date of infringement, described as “very serious” took place on July 30th, 2021.

In the “reported facts” it can be read: “Participating in a botellón. On July 30th, 2021, at 21.15, the Formentera Policía Local, together with the Guardia Civil, intervened in a botellón of more than 200 people, who were not respecting the safety distance, were not using masks, smoking, drinking and singing without complying with current regulations on the beach Cavall d’en Borràs, la Savina, Formentera”.
