The Guardia Civil of Ibiza, pending the baby’s condition to act against the anti-vaccine doctor

The College of Doctors reiterates that it "will not stand idly by" and that it will "probably" file a legal complaint against Ángel Ruiz-Valdepeñas

The Guardia Civil of Ibiza is still investigating the anti-vaccine doctor’s participation in a birth at a residence in Santa Eulària, as well as the measures against anti-vaccine doctor Ángel Ruiz-Valdepeñas, who was suspended for six years as a result of this. The baby experienced a cardiorespiratory arrest and is currently in critical condition at Son Espases. The College of Physicians maintains that this doctor is not a registered physician and hence cannot practise. He responds that he is not barred from practising because he has appealed the sentence.

According to Guardia Civil sources, the agents are continuing their work and are waiting to see how the infant develops, as the prospective charges resulting from this inquiry could differ depending on this.

The Health Department declared Monday that, at the parents’ express request, it will not give any further details on the condition of the newborn brought to Son Espases’ paediatric ICU. The small girl had a cardiorespiratory arrest and was immediately taken to Can Misses Hospital.

Last May, the Medical Association of the Balearic Islands (Comib) sanctioned the doctor with a six-year suspension and a cost of 16,660 euros for denying the epidemic. The institution communicated this in a statement after notifying the affected person of the conclusion of a disciplinary procedure for major violations of several provisions of the Code of Ethics and Medical Ethics.

Furthermore, the Comib is considering, in collaboration with its legal services, how to act and “what action to take” prior to this doctor’s participation in childbirth, which he confirmed to Diario de Ibiza. “We will not sit idly by,” said Carles Recasens, vice president of Comib, adding that the College’s move “would most likely be through Justice.”

As a result of some denialist statements made by this doctor in 2020, the Comib launched an investigation into his conduct, believing it to be “deontologically dubious.” Following a lengthy investigation, the College determined that the doctor had breached points of the code of ethics, resulting in a six-year suspension from membership and a financial penalties.

This resolution was transmitted to the Comib, which evaluated and ratified the Comib’s decision.

Comib was aware that this doctor had filed a judicial appeal against the ruling, but they were unaware that he had restarted his practise.

Disqualified from the membership

In this regard, Comib’s vice-president clarifies that while this physician is not disqualified, his membership has been suspended. “This person raises problems of disqualification, but we as a college can only suspend or remove a member,” Recasens recalled.

According to Recasens, professional disqualification must be decided through a legal process. However, he noted that a doctor’s professional licence suspension already hinders him from working “since in Spain, by law, to be able to work as a doctor, one must be a member of a professional licence.”

Comib’s vice-president stated that they have received no judicial notification on a purported lawsuit against the College or its president, José Manuel Valderde. However, he stated that this doctor has stated his desire to make a complaint on multiple times.
