From behind, by surprise and “without any consent”, according to the prosecution’s brief in a trial for sexual assault held this Wednesday at the Provincial Court of Palma. The accused is P.M.J., a Polish national with no prior criminal record.
The events took place in a nightclub in Platja d’en Bossa on Saturday, 16 September 2023 at around 6 p.m. According to the indictment, the defendant, “with the intention of satisfying his sexual desires, approached the woman from behind and inserted his fingers into her vagina without her consent”.
Arrested by the Local Police
After the woman reported what had happened, the man was arrested shortly afterwards by officers from the Sant Josep Local Police, brought before the court and detained for five days, until 22 September.
The prosecution notes that there was an agreement between the parties and that the accused deposited 15,000 euros in court as compensation for the victim, a mitigating circumstance. For this reason, despite the conviction, he will not serve a prison sentence. In addition, he will be prohibited from approaching the victim within 500 metres or communicating with her by any means. He must also pay the costs of the legal proceedings.
