Sant Josep will demolish the illegal works on a mansion in Comte if the owner won’t

Sant Josep will initiate the subsidiary execution file, as with Casa Lola, to reestablish legality since, in addition to extensions, there is a new construction located on protected rural land.

The Sant Josep City Council will initiate the execution proceedings for the demolition of the illegal works carried out on the mansion owned by billionaire Vladislav Doronin, located on the estate called Can Xuruiana (Cala Comte), as happened with the Casa Lola complex a few weeks ago, if the property does not re-establish the legality of the structure on the plot.

In this case, the Consistory would have to request judicial authorization to access the interior and execute the demolition of the illegalities. The cost of this work would be added to the fine faced by the owner.

Sant Josep dismisses appeal

This decision against the property (Inversiones Rapa Nui 2012 SL) has been adopted by the City Council after dismissing, last June, the appeal filed by the developer against the resolution of the infringement proceedings.

It should be recalled that the works carried out on the property are considered to be a “very serious” urban infraction, for which a penalty of 1.1 million euros is imposed on the property and the builder of the illegal works (Estructura y Cimentaciones Ibiza SL), which represents 175% of the value of the works.

The background dates back to March 2014, when the municipal urban services detected works carried out on the house that did not have a license.

These consisted of the modification of facilities, replacement of paving, rehabilitation of beams and placement of waterproofing and coatings in the entire construction (exceeding the area of the legal and authorized part) and demolition of the existing porch.

Terrace, septic tank…

As for the exterior of the house, earthworks were carried out in the access area, the existing septic tank was removed and a terrace, porch and elevated wooden walkway were built. The house was enlarged by approximately 225 square meters, according to the technical report prepared by the Sant Josep City Council, which calculated that the material execution budget of the works in progress amounted to 626,220 euros. This led the Sant Josep City Council to initiate a file for the protection of urban legality.

Faced with this situation, the property presented a request for legalization of the extensions executed on the house, but in August of that year they were denied by the Governing Board.
