Residents denounce the continuing “inaction of Sant Josep” against noise and that “the situation is worse”

The Sant Josep City Council argues that things have changed "a lot, for the better, and now equipment is being sealed".

Five neighbors, united by the weariness of enduring the excess of noise in their homes from entertainment venues in Platja d’en Bossa, have achieved that the Courts recognize the passivity of the City Council of Sant Josep when in 2013 they requested to take measures, such as the sealing of musical equipment, to reduce noise levels to the limits set by the regulations.

A few days ago, the government team of Sant Josep, formed by the PSOE and Unidas Podemos, released a statement in which it expressed, in response to the ruling of the Balearic Islands High Court of Justice that dismissed its appeal, that it regretted “the suffering of the neighbors” and blamed it on the PP and Nova Alternativa, the parties that governed the municipality in summer 2013, when the facts were reported. “They will have to explain to the citizens why they tolerated this situation, having results that repeatedly demonstrated that the music in Platja d’en Bossa far exceeded the legal limits,” it said.

In the same note, the progressive municipal government pointed out that the sentence “does not imply any sanction or have consequences for the institution,” although it did recognize that it is “a moral condemnation to a way of operating that should not be repeated.” “Fortunately for our neighbors, this slap in the face of the courts comes when those who deserve it [referring to PP and Nova Alternativa] are no longer around to receive it, but it is theirs,” the statement concluded.

Journey of the affected Sant Josep residents

The sentence laments “the administrative and judicial journey that has led the neighbors to a poor municipal action.” “We are now in 2022 and there is also no documented evidence that the sanctioning files of 2013 have concluded in any way or that measures or sanctions were adopted,” adds the court ruling of the Balearic court.

One of the five complainants, Antonio Villalonga, argues that “inaction” by the Sant Josep City Council against noise “continues” and that even now “the situation is worse than in 2013.” “There are more parties and more noise. You call and the Sant Josep City Council does not act”, indicates Villalonga, who then clarifies that it does take measures against “music bars” and “uses it as an excuse to justify that it is acting”, but “it does not do so against the main sources of noise”, referring to DC-10 and Ushuaïa.

“Why in some establishments the musical equipment is sealed and in others not?”, questions Villalonga, who, despite being linked to the new political party Per Balears (with former socialists Antonio Roldán and Paquita Ribas), says that his complaint against noise is “personal”, outside the party.
