Prosecution claims cameras incriminate accused Ibiza murderer; defence says there is no proof

The trial for the deadly arson attack in a house in ses Païsses (Ibiza) in the summer of 2023 began this Monday at the Provincial Court of Palma. The prosecution — both the Public Prosecutor and the private prosecution — argues that the alleged perpetrator, who remains in custody, acted with malice aforethought, following a premeditated plan and with a clear intention to end the life of the elderly man who lived there and ultimately died.

The defence, meanwhile, has described the investigation as poor and maintains that “there is no evidence or science” to prove the guilt of the woman on trial. She insists she is innocent and is seeking an acquittal. On this first day of the trial — which has a jury and is expected to last until next week — no evidence has yet been presented, as this phase is reserved for the coming days.

The defendant, a 63-year-old Spanish woman, is accused of murdering a 78-year-old man she had been caring for by allegedly setting fire to the house, where the victim, his wife and a third caregiver were present. The prosecution is seeking life imprisonment with the possibility of review, as well as substantial compensation.

“Once inside, with the intention of ending the lives of those who were there — since she was fully aware that at that hour [around two in the morning] they would be sleeping — and in order to ensure the intended result without risking her own safety, she used a particularly dangerous and effective method to guarantee death”, reads the prosecution’s statement. It concludes that the defendant was able to enter the property with keys she had because she had been looking after the couple until 20 days before the events and was at the time in a romantic relationship with the victim’s son.

“And so, she went to the garage of the home, piled up several cushions next to the car, set them on fire, then left the house and allowed the flames to spread”.
