A diving instructor accused of raping a German tourist on a boat in Cabrera explained today in court that he had sexual relations with her, but that they were consensual. “She was enjoying it”, the accused claimed. According to his version, the two made out when her family was diving and when they returned to land they went for a beer as normal. The Public Prosecutor’s Office is demanding a 10-year prison sentence for the accused for the crime of sexual assault. The young woman, for her part, has ratified her complaint and explained that the man forced himself on her.
The events occurred on july 15, 2020. A man and his two daughters hired a diving excursion with a company from Santanyías they had been doing for several years during their vacations on the island. A monitor went with them, who took them to the Cabrera area for a dive. The defendant, 40 years old, took advantage of the fact that had been left alone on the vessel with one of the girls, aged 20. According to the prosecution, the man hugged the victim, began kissing her, and ended up undressing her and forcing her to have sexual relations. He took advantage, the prosecution says, of the fact that the woman was unable to call for help. As a result of the rape, the young woman suffered a aggravation of her depressive disorder he was suffering from.
The defendant has acknowledgedduring the trial held at the Provincial Court of Palma, that he had full sexual relations with the girl, but has argued that they were consensual. He has told that after a first dive, she decided to stay in the boat while her father and sister went back to dive. “We were fooling around a little bit. I held her hands, kissed her and we made out. There was complicity.”he assured.
The defendant explained that they were groping each other and that she did not reject him. “I was enjoying myself.”he has assured. On a couple of occasions, he admitted, the girl told him to stop because he had a girlfriend. “I told her she wasn’t going to find out. He didn’t push my hand away; he took off his wetsuit. He had an active attitude. He was moaning with pleasure.”; he has stated. The man has stated that they then took a bath and she gave him her phone. When his father and sister returned to the boat, they went back to land and all went for a drink without any problems.
The girl, for her part, has ratified that the accused raped her. In her statement she said that she suffered a mishap on her first dive that day and decided to stay in the boat for the rest of the excursion. Thus, he was left alone in the boat with the monitor. “We didn’t cross a word, there was no flirting. He sat behind me and kissed the back of my neck. I was very scared. He grabbed my head and tried to kiss me. I put my hand to push him away. I said “no” several times and went to the other side of the boat, but he followed me“, he said.
The young woman said that the monitor held her down and insisted that she asked him “seven times” to stop. “He wanted to pull down my wetsuit. I was very afraid of falling into the water.”she said. According to his version, the man ended up penetrating her against her will.
