The presence of the current beach kiosks on Formentera‘s shores is hanging by a thread. According to an exhaustive technical and legal report by the Balearic Government’s Department of the Sea and the Water Cycle, accessed by Diario de Ibiza, the “failure to comply with essential conditions linked to the seasonal and removable nature of the installations, as well as their correct location and size”, calls for the “initiation of the procedure to declare the expiry of concession CNC02/21/07/0045”. This would entail the withdrawal of the administrative concession granted to the Consell de Formentera, which covers not only the kiosks but also sailing schools, beach bars, lifeguard towers and other facilities.
The new concessionaires of these services, who opened just a year and a half ago, have faced constant controversy ever since. This has been due in part to protests from most of the former operators, who have repeatedly pointed to alleged irregularities both in the tender process through which the licences were awarded and in the day-to-day operation of the kiosks once they became active. These complaints were compounded last January by a formal report filed by a Balearic environmental organisation.
Order to dismantle
Among the breaches highlighted in the final report, dated 12 November this year, is the failure to comply with the order to dismantle the installations between 15 January and 15 February. This led the Consell de Formentera to open sanctioning proceedings, which were settled with a fine of €1,500.01.
The file also includes a report dated 7 November 2025 by the head of the Concessions Service of the Balearic Government’s General Directorate of Coasts and Shoreline, part of the Department of the Sea and the Water Cycle. This document identifies the failure to dismantle the facilities as the most serious infringement, although it is not the only issue detected and documented during successive inspections.
