The Consell de Ibiza has launched a sanctioning process against the developers of illegal construction works in a mansion located in Es Cubells, Sant Josep municipality. The infraction amounts to more than 2.4 million euros and involves reinstating town planning discipline. According to a statement from the insular institution, the Consell has also referred the case to the Prosecutor’s Office of Ibiza in the event that these actions constitute a criminal offense.

The penalty for the illegal construction works carried out by those responsible amounts to over 2.4 million euros. Notably, the owner and promoter of the works, as well as the builder, face the highest penalties, with 1.2 million euros and 1.04 million euros respectively, as highlighted in the note.

In addition to proposing sanctions, the case file includes initiating the demolition procedure and restoring legality to a series of constructions. The project includes 19 structures in total, such as a 360 m² house that underwent complete renovation, two new annexes measuring 50 m² and 18 m² respectively, five new gazebos (two with 38 m² and the remaining three with 45 m², 20 m², and 75 m²), four new porches (measuring 5 m², 6 m², 40 m², and 16 m²), a new 60 m² swimming pool, 100-meter-long access stairs to the coast, a new 60 m² platform, a new 8 m² second floor, and partial renovation of the house in the main room and living room areas.

During this legislative period, the Department of Land Management has made significant strides in enforcing land management regulations. Specifically, the department has successfully demolished five illegal structures, including a house in Cala d’Hort, a house in Corona, two yurt-type constructions in ANEI, and a coast installation. Additionally, the department has filed six complaints with the Prosecutor’s Office for crimes against land management on protected land. It’s important to note that in addition to the corresponding penalties, these violations can result in up to four years of imprisonment.

Mariano Juan, the conseller of the Department of Land Management, wants to highlight the proposed sanction not only for the promoter of the work but also for the builders. According to Juan, builders have the responsibility to ensure that the promoter has obtained the necessary license before beginning any construction work.
