Spain’s Supreme Court has issued a ruling that directly affects a luxury residential development in Es Cubells, in the Ibizan municipality of Sant Josep. The decision resolves an economic dispute between several property owners and the Los Parques de Es Cubells Association, which was responsible for managing repair works to the area’s access roads after the torrential rains of 2017 that forced the evacuation of dozens of residents.
The events date back to August of that year, when heavy rainfall caused severe damage to the development’s roads and access points. The Sant Josep Town Council declared a state of emergency and ordered the evacuation of the affected homes due to safety concerns.
To address the damage, property owners in the area created the Los Parques de Es Cubells Association to coordinate repair works and guarantee the safety of access routes to the houses. The association agreed to finance the works through contributions from residents, calculated according to the built area of each property.
However, some owners who were not members of the association refused to pay the amounts requested, arguing that they were not bound by the decisions of a private entity to which they did not belong, and that the payment criteria violated the original regulations of the development.
