The Swiss national was sentenced to nearly two years in prison for raping a young woman he had met at an Ibiza nightclub. A plea agreement reduced the prosecution’s original five-year prison request, with the defendant paying €30,000 in compensation to the victim.
A Swiss man has accepted a prison sentence of one year, 11 months and 29 days for raping a young woman he met just hours earlier at a nightclub in Ibiza. He will not serve time behind bars following a plea agreement reached before trial, which resulted in a sentence of less than two years. The agreement also required him to pay €30,000 in compensation to the victim, a sum he has already paid, and imposed a five-year restraining order.
The sentence represents a substantial reduction from the initial charges brought by prosecutors, who had sought five years in prison for sexual assault involving penetration, along with €50,000 in compensation for the emotional harm and psychological damage suffered by the victim.
The incident dates back to the night of 27 September 2019. According to the account set out by the Public Prosecutor’s Office in its provisional conclusions, the defendant was at an Ibiza nightclub with three friends when they met the young woman and her friends. All those involved were of Swiss nationality or origin.
After spending part of the night dancing, the group decided to move to a property rented by the defendant and his friends on an estate in Sant Antoni, on Ibiza’s west coast. Once there, they played cards. During the night, the defendant and the young woman began kissing and touching each other consensually.
An encounter in a treehouse
At around 7am, according to the prosecution’s account, the man suggested that the young woman accompany him to a small treehouse in the property’s garden to watch the sunrise. Once there, they began kissing again.
The prosecution alleged that the defendant touched the woman’s genitals and inserted his fingers. She pushed his hand away and told him no.
As the woman was preparing to leave the treehouse, the defendant pulled down her leggings and raped her vaginally on three occasions, despite her making it clear, according to the prosecution, that she did not want to have sex and wanted to leave.
The young woman eventually managed to climb down the structure’s movable ladder and walked back towards the rest of the group. On the way, she stumbled on some steps and suffered abrasions to her knees. Her injuries required a single medical consultation and took around 15 days to heal.
The incident also had an emotional and psychological impact on the victim.
Nearly seven years after the incident, the plea agreement reached by the parties has allowed the convicted man to avoid serving his prison sentence.
