Legal reforms in addressing illegal tourist homes

Another of the legislative reforms that the new government of the Consell de Ibiza will demand from the Balearic Government also affects the fight against intrusiveness. The PP is seeking a modification of the law that would enable the Consell to adopt precautionary measures, such as the suspension of the activity (sealing, as in a restaurant), while a sanction file is being processed against an illegal tourist dwelling.

The importance of this measure lies, according to Mariano Juan, in that if the owner ignores the precautionary suspension and continues with the illegal activity, he faces “a crime of disobedience”, which has “another magnitude”. “This would help a lot to combat certain organized networks and big exploiters,” he points out, while adding: “We must articulate legal mechanisms, also criminal ones, so that not only administrative weapons are used,” he justifies.

Precisely, another issue that will be put on the table to “analyze” whether or not it is feasible, is to articulate legal mechanisms so that municipalities, through local police, can “collaborate in the fight against illegal tourist apartments”. Juan explains that “decades ago” on the island, the exploitation of the former tourist homes was considered an activity and, as such, required specific licenses.

“This no longer happens. Only a declaration is processed before Tourism and municipalities can not do anything or control anything, “says the vice president, who recalls that in Barcelona is considered an activity the exploitation of tourist apartments. “I do not dare to say if it can be done or not [modificar la normativa autonómica balear en este sentido] and why can it be done in Catalonia? “In some autonomous communities it is appealed and in others it is not”, justifies Juan.
